Acceptance of the general conditions of sale

Shipping & Delivery

1 - Deadline

 

Your request is taken into account immediately after receipt of payment and leaves our warehouses within 24/48 hours, working days, in most cases. During the ordering process, the delivery time is specified before validation of the order depending on the carrier and product chosen. The sender reserves the right to use any other means of delivery while respecting the expected delivery times and costs. 2 - Reserves

 

In the event of a problem, the customer will make any reservations corresponding to the observations noted on the carrier's payment sheet, have the delivery person co-sign and keep a copy of the document.

 

In the event of transport damage, the customer must refuse the damaged product to the delivery person and indicate “Refusal for damage” on the payment sheet.

If the customer was unable to notice the transport damage upon delivery and in accordance with article L. 133-3 of the Commercial Code, receipt of the transported objects extinguishes any action against the carrier for damage or partial loss. if within three days, not including public holidays, following that of receipt, the customer has not notified the carrier, by bailiff's deed or by registered letter, of his reasoned protest. It will therefore be appropriate to notify the carrier within 3 days as well as SOURIRE DES SAVEURS SARL. After this period, no appeal will be possible.

In the event of delivery not conforming to the order in quality or quantity, the customer must inform SOURIRE DES SAVEURS SARL, indicating the order reference. (Article L. 121-19-4).

 

3 - Customs outside France

When the customer orders products on the Sourire des Saveurs website for delivery outside France, he may be subject to import obligations and taxes, which are collected when the package arrives at its destination in the country of delivery. Any additional customs clearance costs will be their responsibility; we have no control over these charges. Customs policies vary greatly from country to country, so the customer should contact the local customs department for further information. Furthermore, the customer will be considered the importer of record and must comply with all laws and regulations of the country in which he receives the products. The protection of our customers' privacy is important to us and we draw the attention of our international customers to the fact that cross-border deliveries are likely to be opened and inspected by customs authorities.

Right of withdrawal (articles L. 121-17 and L. 121-21-3 to L. 121-21-5 of the Consumer Code) :

 

1 - Withdrawal period - Goods concerned and excluded

 

In accordance with the aforementioned articles, the customer has a period of 14 days – “calendar days” – to change his mind about his purchase. This right of withdrawal also applies if the product is on sale or out of stock.

Furthermore, this right of withdrawal does not apply (Article L. 121-21-8 of the consumer code) :

 

-          on goods that deteriorate or perish quickly,

 

-          on goods that you have opened and cannot be returned for reasons of hygiene or health protection,

 

-          on goods inseparable from other articles,

 

-          for contracts for the supply of goods made to the consumer's specifications or clearly personalized. No right of withdrawal can therefore be applied for products sold on the site. 2 - Calculation of the withdrawal period

4 - Product return (Article L. 121-21-3 of the consumer code)

 

The goods will be returned by the customer no later than 14 days following sending of the withdrawal decision. The costs associated with returning the goods are the sole responsibility of the customer.

 

The customer is responsible for the depreciation of the value of the product(s) resulting from manipulations (other than those necessary to establish the nature, characteristics and proper functioning of this product(s)).

5 - Reimbursement by SOURIRE DES SAVEURS SARL (deadlines and means)

 

In the event of withdrawal, SOURIRE DES SAVEURS SARL will reimburse you, including delivery costs. The professional is not required to reimburse the additional costs if the consumer has expressly chosen a more expensive delivery method than the standard delivery method offered by the professional. Reimbursement will take place within 14 days following recovery of the goods. Returned products must be deemed “fit to be re-marketed” (article L. 121-21-4 of the Consumer Code).

 

After this period, the amounts owed by SOURIRE DES SAVEURS SARL will be automatically increased in accordance with article L. 121-17 of the Consumer Code.

 

SOURIRE DES SAVEURS SARL undertakes to reimburse its withdrawing customer by the same means of payment used during the purchase. However, with the agreement of his customer, he can use another method of payment without additional costs payable by the customer.

Guarantees and hidden defects:

 

1 – Guarantee of conformity:

 

In accordance with articles L. 111-1 and L. 211-4 to L. 211-14 of the Consumer Code, SOURIRE DES SAVEURS SARL respects the obligation to deliver goods in conformity with the contract and to respond to any lack of conformity existing during the delivery of the property.

Force majeure

Payment

 

Payment for products and services may be made in various ways, subject to all necessary verifications. Until effective receipt of all sums due to it, SOURIRE DES SAVEURS SARL remains the owner of the products delivered and reserves the right to recover them by any means at its disposal in the event of default by the debtor.

 

By express agreement when ordering (and unless otherwise agreed or professional accounts), payment must be made at the time of ordering.

 

For professional customers, no further orders can be fulfilled until payment has been made. No cash discount will be given for early payment. Law 99-1442 of 12/31/1992: After the agreed payment deadline, SOURIRE DES SAVEURS SARL reserves (according to the agreement made with the customer) the right to issue either a L.C.R. or an automatic debit, which will be presented immediately to the customer's bank or postal account. The amount will be increased by late payment penalties equal to 3 times the legal interest rate and bank charges. If the mentioned deadline is exceeded, the customer will have to pay a fixed compensation fixed by decree of €40 at the time of payment.

Under articles L441-6 and L443-1 of the commercial code, payment cannot exceed legal deadlines.

Disputes

The General Conditions of Sale are subject to the provisions of French law.

 

SOURIRE DES SAVEURS SARL will endeavor to find a commercial and concerted solution for any possible disputes that may arise during the processing of any order. The customer must contact SOURIRE DES SAVEURS SARL by email “contact us” to inform them of this dispute.

 

Failing this, any dispute is brought :

-          for professionals: before the Toulouse commercial court;

 

-          for individuals: before the competent court in accordance with articles L. 141-5 of the Consumer Code as well as 46 and 48 of the new Code of Civil Procedure.
